1. Agreement to Terms
By downloading, installing, or using FamaApp ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the App.
These Terms constitute a legally binding agreement between you and FamaApp ("we", "our", "us"). We reserve the right to modify these Terms at any time, and your continued use of the App constitutes acceptance of any modifications.
2. Description of Service
FamaApp is a business management application designed to help small and medium businesses manage their daily operations. The App provides the following services:
- Point of sale and sales recording
- Product and inventory management
- Expense tracking and financial reporting
- Customer and supplier management
- Purchase order management
- Employee management and access control
- Invoice and receipt generation
- Manufacturing and production management
- Business analytics and reporting
3. Account Registration
To use FamaApp, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and update your account information to keep it accurate
- Keep your login credentials confidential and secure
- Accept responsibility for all activity that occurs under your account
- Notify us immediately of any unauthorized use of your account
You must be at least 18 years old or the legal age of majority in your jurisdiction to create an account and use the App.
4. Subscription & Payments
4.1 Free Trial
New users may receive a free trial period. During the trial, you have access to all features of the App. After the trial expires, you must subscribe to a paid plan to continue using the App. Any unused portion of a free trial period will be forfeited when you purchase a subscription.
4.2 Auto-Renewable Subscriptions
- FamaApp offers auto-renewable subscription plans (e.g. Monthly, 3 Months, 6 Months)
- Payment is charged to your Apple ID account (App Store) or Google Play account at confirmation of purchase
- Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period
- Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price
- You can manage and cancel your subscriptions by going to your device Settings > Apple ID > Subscriptions (iOS) or Google Play > Subscriptions (Android)
- Prices are displayed in the App and may vary by region and currency
- We reserve the right to change subscription pricing with reasonable notice
4.3 Refunds
For subscriptions purchased through the App Store or Google Play, refund requests are handled by the respective platform according to their refund policies. If you experience a billing error or the App fails to deliver the services described, please contact us within 7 days for assistance.
5. Acceptable Use
You agree not to use FamaApp to:
- Violate any applicable laws or regulations
- Conduct fraudulent, deceptive, or illegal business activities
- Upload malicious code, viruses, or harmful content
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with the App's functionality or security
- Use the App to harass, threaten, or harm others
- Scrape, copy, or redistribute data from the App without permission
- Use the App on behalf of a third party without their authorization
We reserve the right to suspend or terminate your account if you violate these terms.
6. Your Data & Content
- You own and retain all rights to the business data you enter into FamaApp
- You grant us a limited license to store, process, and display your data solely for the purpose of providing the App services
- You are responsible for the accuracy of the data you enter
- You are responsible for maintaining your own backups of critical business data
- We do not claim ownership of your business data

7. Intellectual Property
- FamaApp, including its design, code, features, and brand, is owned by us and protected by intellectual property laws
- You may not copy, modify, distribute, or create derivative works from the App
- The FamaApp name, logo, and trademarks may not be used without our written consent
- All feedback or suggestions you provide may be used by us without obligation to you
8. Service Availability
- We strive to provide 99.9% uptime but do not guarantee uninterrupted service
- We may perform maintenance that temporarily affects availability — we will provide notice when possible
- We are not liable for losses caused by service interruptions due to internet connectivity, device issues, or force majeure
- We reserve the right to modify, suspend, or discontinue features with reasonable notice
9. Limitation of Liability
To the maximum extent permitted by law:
- FamaApp is provided on an "AS IS" and "AS AVAILABLE" basis
- We make no warranties, express or implied, regarding the App's fitness for a particular purpose
- We are not liable for any indirect, incidental, or consequential damages arising from your use of the App
- Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim
- We are not responsible for business decisions made based on data in the App
10. Termination
- You may stop using FamaApp at any time and request account deletion
- We may suspend or terminate your account for violation of these Terms
- Upon termination, your right to use the App ceases immediately
- We will retain your data for 30 days after account deletion to allow recovery, after which it will be permanently removed
11. Dispute Resolution
Any disputes arising from these Terms or your use of FamaApp shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved under the laws of the United Republic of Tanzania, in the courts of Dar es Salaam.
